The Patna High Court recently ordered the state to provide information to the court on the condition of vaccination, the percentage of tests conducted, and the state's health facilities. Chief Justice Sanjay Karol and Justice S. Kumar also noted that the State had refused to act on its claim form dated May 13, 2021, which related to the declaration of a strike/self-isolation called by the "Bihar State Contractual Health Employees Federation" during the pandemic. As a result, Additional Advocate General Anjani Kumar was tasked with ascertaining whether a decision had been reached on the applicant's grievances.

The Division Bench also asked the AAG to start investigating the facts of this case

(a) vaccination in Bihar;

(b) the percentage of daily tests performed and the positivity rate found in Bihar; and

(c) the access to healthcare available in the district/sub-division."

As a result, a new hearing date has been set for this week. An interlocutory application filed in a related case, underlining the plight of Ayush doctors who work on a contract basis in the state, was also dismissed by the Division Bench. The applicants' right to approach the State's Principal Health Secretary with their grievances was preserved by the Court in this case. The authority was told to resolve the matter as quickly as possible in accordance with the law, and it was suggested that a decision be made within three months. Advocate Shivani Kaushik represented the petitioners, and Amicus Curiae Mrigank Mauli was appointed in this case. The applicants were also given the option of filing a petition on the same cause of action on their own, if necessary, and requesting that it be listed on a priority basis. As a result, the Registry was directed to take steps to list the petition as soon as possible if and when such mention is made.
