The Allahabad High Court last week affirmed the detention of 3 men under the National Security Act, 1980, who are accused of burning a young girl alive by pouring petrol on her, causing her death. Due to this heinous crime, public order was disturbed, and parents in the area forbid their children from going to school. Briefly, the facts On February 1, 2020, a girl, who was a B.Sc. III Year student was kidnapped from Ram Naresh Hotel in Raebareli by the petitioners and other co-accused persons. A rope was used to bind her hands and feet. In a state of unconsciousness, they took her to a nearby orchard of eucalyptus trees, where they burned her to death with petrol. According to the charge sheet filed by the investigating officer against the petitioners and four other co-accused persons, the petitioners and other co-accused persons had committed the said heinous crime, which was found to have been committed by the petitioners and other co-accused persons.

Allegations were made that due to the murder of a young girl, the public's mood was disturbed and the parents of a local girl were making unfavorable statements against government officials and the district administration. Since the petitioners had applied for bail before the Hon'ble High Court, there was a possibility of their release on bail and resumption of such activities that were likely to jeopardize public order; thus, the detention by the detaining authority was passed under the Act, 1980 [invoking the provisions of Section 3 (2) of the Act] As a result, the Detaining Authority issued the contested order on August 27, 2020, detaining the petitioners in accordance with Section 3 (2) of the Act of 1980. The petitioners sent their representation on September 5, 2020, which was rejected by the Detaining Authority on September 8, 2020, and another representation sent by the petitioners to the State Government was also rejected on September 18, 2020. On November 11, 2020, the Central Government also rejected the representation.
