The Orissa High Court has ordered those new notices be issued to the Respondents in a decade-old case seeking compensation for a lawyer-activist who was allegedly imprisoned on the false charge of sedition. After observing that the case had only been listed twice in the last decade and that service of notice had not been completed, a division of the bench of Chief Justice Muralidhar and Justice BP Routray reactivated the matter by ordering new notices. On August 12, 2008, the petitioner, a lawyer-activist, was arrested on suspicion of participating in the banned CPI (Maoist) subversive activities on several counts, including murder, dacoity, and sedition, for participating in a "people's protest." She was charged in two separate cases. After nearly two and a half years in prison, the petitioner was acquitted of all charges. She filed a petition seeking restitution and punishment for the officers involved in the allegedly fabricated cases that caused her mental trauma and public humiliation.

The Division Bench noted that the case had only been listed twice in the previous ten years, in February and September of 2012. It also stated that the service of notices was incomplete due to a lack of correct addresses, and that the report of the service of notices to opposing parties was unavailable. As a result, the Bench ordered the State Home Department to provide the correct addresses of the opposing parties within four weeks. According to the order, "The opposing parties are not residing at the addresses listed in the petition's cause title. Because they were police officers, we direct Opposite Party No.1 to provide the Registry with the correct current addresses of Opposite Parties 4, 5, and 8, with a copy to learned counsel for the Petitioner, within four weeks. Following that, the Petitioner shall file the necessary documents for service of notice by Registered Post with A.D. to Opposite Parties Nos. 4, 5, and 8.” The case has been scheduled for a hearing on November 16.
