[Case of Copyright] The Allahabad High Court has refused to provide interim relief in the case of 'Chehre,' starring Amitabh Bachchan. The Court stated that while the movie and the allegedly plagiarised copyrighted work appear to have come from the same source, their treatment and development are fundamentally different. In a case alleging copyright infringement, the Allahabad High Court has declined to award any interim relief against the distribution of Amitabh Bachchan's Bollywood blockbuster 'Chehre' (Uday Prakash v. Anand Pandit). While the movie and the copyrighted work alleged to have been plagiarised appear to have come from the same source, they are treated and developed in significantly different ways, according to single-judge Justice JJ Munir.
The Court was considering an appeal from a District Judge in Ghaziabad who had denied plaintiff Uday Prakash's motion for an interim injunction in his copyright infringement action. Prakash claimed that the defendant, Anand Pandit, the producer of 'Chehre,' plagiarised his original script. The complainant claimed that he had received copyright registration for his work under the name 'Highway-39' from the Copyright Office in New Delhi way back in 2007. The plaintiff claimed that he has not yet assigned, transferred, or sold his copyright in the copyrighted work to anybody else, and that he owns it solely in his name. According to the plaintiff, the infringement of his copyright is causing him to lose his name and reputation. It was further asserted that the plaintiff would face significant harassment, loss of reputation, and a cascading impact on his career prospects as an author as a result of the infringement caused by the creation and release of the feature film.
The Court, on the other hand, analysed the two screenplays and concluded that, while the main premise is the same in both, there are "a slew of variations in the script leading up to the feature film." In light of this, the Court denied the motion for a temporary restraining order to prevent the film's release. The Court, on the other hand, ordered the trial court to determine the case quickly and finish the trial within four months. The Court further said that all of its remarks are for the purpose of making a judgement on the issue of a temporary injunction and have no impact on the trial.
