The Allahabad High Court as of late remained the arrest of a law student who was accused of impersonating and cheating. He was accused of the said crimes after he had shown up before the Motor Accidents Claims Tribunal (MACT) and looked for a suspension for a situation where the legal advisor under whom he was interning was appearing on behalf of one of the parties.
A Division Bench of Judges Devendra Kumar Upadhyaya and Saroj Yadav said that its prima face had all the earmarks of being an over passionate endeavour by a law assistant to look for intermission in the situation where the advocate under which he was interning was supposed to be representing one the parties involved. "It doesn't give off an impression of being a situation where the petitioner is said to have imitated himself as a legal advisor. At first sight, it appears to us that the applicant over-fanatically endeavoured to look for suspension for a situation where one of the gatherings seems to have been addressed by the learned Advocate under whom the candidate was interning," the Court noted.
The request was passed on an appeal by one, Abhay Kumar Gupta, a law student, looking for suppression of the FIR against him for offences under Section 419, Section 420 and Section 171 of the Indian Penal Code, 1860. These sections stipulate impersonation, cheating and wearing garb or carrying tokens used by a public servant with fraudulent intent respectively. Advocate Anil Kumar Mishra who appeared on behalf of the intern presented that the petitioner was interning under a legal advisor at the District Court, Rae Bareli and because of his interest and as a piece of his preparation, he had been going to the court procedures.
On one such event, while going to a procedure at MACT, he looked for intermission in one case in which his senior was one of the advisors. Advocate Mishra likewise drew the consideration of the Court to the request for the managing official of the MACT dated October 4, 2021, which unmistakably recorded that on being asked, the candidate let the directing official know that he is a law student and not a practising legal counsellor. The Court, at first sight, said that there was no endeavour at impersonation except for it was to a greater extent an instance of exuberant law student endeavouring to contend under the steady gaze of an adjudicator.
