According to the charge-framing sequence, The Court stated that it was “high time” for the Deputy Commissioner of Police for the North-East District and other senior officials involved to take note of its findings and take the necessary prompt corrective measures. It was proposed that top police officers should be able to obtain professional advice in this respect, or else there was a risk of injustice being done to the people concerned in these situations.

The Court had previously expressed regret, stating that it had been made aware that the investigating officers (IOs) in such matters were not briefing the Special Public Prosecutors (SPPs) for charge arguments. Judge Yadav went on to say that it was "painful" that the standard of investigation in many of these cases was so low that after the chargesheet was filed in Court, neither the IO nor the Station House Officer (SHO) or, for that matter, the supervising officers bothered to see what other information was needed from the appropriate authority in the cases. “I am of the considered judgement that prima facie there is adequate information on record to frame charges against the accused people under the required sections,” the Court said on the issue of charge drafting. The two defendants were allegedly "active members of a riotous mob" who actively participated in attacking and injuring police officers on duty at the crime scene by throwing acid at them.
