Drone-related activities are being regulated by the Central Government, and the Central Government is seeking recommendations for Draft Drone Rules. When these Rules are announced, they will take effect and replace the Unmanned Aircraft System Rules 2021, which were implemented earlier this year. The public is asked to submit objections and recommendations until the 5th of August 2021. As stated in the preamble to the draught Rules, the Centre believes that unmanned aircraft systems (drones) present enormous opportunities for economic growth and job creation and that it is necessary to regulate drone-related activities in such a way that they do not pose a threat to the safety and security of people and property in India.

In accordance with the new Rules, the Drone Rules will apply to (a) all persons who own, possess or are engaged in the export, import, manufacturing, and trading of drones in India; (b) all drones that are currently being operated in or over the territory of India; and (c) all drones that are currently being operated in or over the territory of any country other than India. Drones are described as aircraft that can operate autonomously or that can be operated remotely without the presence of a pilot on board. Drone operators in India are prohibited from operating a drone unless it complies with the requirements of a certificate of airworthiness or unless it is exempt from the necessity of a certificate of airworthiness.

An unambiguous identifying number (UIN) should also be assigned to drones. According to the law, anybody who owns a drone that was made in India or brought into India on or before December 31, 2021, must generate a unique identifying number for the drone. Drone operators must be licensed remote pilots to operate their vehicles. Applicants must meet the following requirements: (a) be at least eighteen years old and not more than sixty-five years old; (b) have passed class tenth or its equivalent examination from a recognised Board, and (c) have completed training prescribed by the Director-General for the applicable class of remote pilot license from an approved remote pilot training organisation.
