The Bar Council of India suspended 28 advocates whose names are recorded in FIRs or charge sheets for purportedly documenting counterfeit cases before the Motor Accidents Claims Tribunal (MACT) and under the Workmen Compensation Act. The BCI has likewise guided the Uttar Pradesh Bar Council to start disciplinary procedures against those lawyers. The State Bar Council was approached to finish up all requests within 90 days and spot a report on the request before the BCI.
The activity came after a Supreme Court Bench of Justices MR Shah and Sanjiv Khanna took genuine note of the issue identifying with advocates documenting counterfeit case petitions while hearing the case of Safiq Ahmed versus ICICI Lombard General Insurance. In a specific order, the top court had seen that despite a Special Investigating Team (SIT) being established by the Allahabad High Court to investigate the recording of such cases and for researching the issue, most cases were all the while forthcoming.
"We deplore the carelessness and additionally torpidity concerning the SIT in not finishing up the examination even following 4-5 years and of the FIR," the Bench had noticed.
Keeping in mind the previous order of the court, BCI director Manan Kumar Mishra had shown up before the Bench to hear the matter. During the meeting, he presented that the UP Bar Council neglected to help out the BCI by not sharing names of supporters documenting counterfeit cases.
As per receipt of the names, a hearing was hung on November 19 and the choice to suspend 28 advocates was taken.
