After the second wave of Covid-19, the Delhi HC issued a notice to the superintendent of Tihar Jail, requesting that he show cause why contempt proceedings should not be initiated against him. The Court also ordered the Jail Superintendent to take immediate steps for the treatment of the inmate and to submit his medical report to the Court as soon as practicable. Justice Mukta Gupta opined in this regard that: It is unfortunate that the Superintendent Jail has not made any efforts to take the petitioner to Patel Hospital for surgery, despite the petitioner's need for surgery and the fact that the Covid cases are now under control and normal surgeries are being performed in various hospitals starting in July 2021. Why no contempt proceedings against Mr. Raj Kumar, Superintendent of Central Jail No.4, Tihar, New Delhi, should be instituted, the Court said. He was incarcerated at Tihar Jail and sought interim bail because of his medical condition. During a thorough examination in March of this year, he was admitted to the Patel Hospital for 2-3 days of incision and removal of the painful limpoma. An ECHO and repeat ECG were ordered for him afterward due to his high blood pressure. It was decided to operate on him at the end of the month.

So, the court ordered that surgery be performed on said date, while providing him with adequate security in custody. Hearing revealed that doctors had advised the petitioner to return to Patel Hospital in April due to his high blood pressure. At a later date, the jail superintendent informed the court that he had not taken the petitioner to a hospital because he had not received any notification from Patel Hospital. As part of the case, the court issued a notice to the Jail Superintendent explaining why contempt proceedings should not be initiated against him. It also directed him to be personally present via video conference. Further, the court ordered: Central Jail No.4 Tihar, New Delhi, is directed to take immediate steps to get petitioner admitted in Patel Hospital in custody, if so, advised by the hospital, so that surgery can be performed at the petitioner's expense." On August 18, the matter will now be heard.
