In response to a petition on the issue of overcrowding in prisons, the Orissa High Court recently ordered the personal attendance of the state's Inspector General of Prisons, while also ordering the formulation of long-term plans on a consultative basis in order to address the issue. A division bench consisting of Chief Justice S. Muralidhar and Justice S.K. Panigrahi also directed the Inspector General of Prisons to file an affidavit updating the statistics and the exact numbers of inmates who have been transferred from one jail to another, or some other suitable location, within 30 days.

The Court also ordered that the IG, Prisons be present in virtual mode on the following date, with the appropriate records in his office, in order to respond to any questions on the aforementioned affidavit, according to the Court's ruling. Affidavits presented in the matter by the Inspector General of Prisons and the State Government were taken into consideration by the Court. Specifically, the first affidavit indicated that as of the 3rd of June in the year 2021, 1239 detainees had been transferred or were in the process of being transferred from overcrowded jails to less crowded jails.

Further, on July 7th, 2021, another document was produced, which indicated that 1376 prisoners' cases were being considered for relocation as of that date. Concerning the issue of female and male convicts above the age of 60 who are held in prisons, the Court took note of an affidavit filed by the State Government, which said that it had adopted the suggestions made by amicus curiae regarding special treatment for such prisoners. A direction was issued to the State Government to present before the High-Power Committee for the State of Odisha the suggestions of the AC contained in paragraphs 7 and 8 the note submitted by him on 24th June 2021, which had been accepted by the State in its affidavit dated 13th July 2021, which had been accepted by the AC.

The subject will now be considered on the 26th of August, according to the schedule.
