The Bombay High Court was informed by the BCI that its directive would only be effective prospectively. For law students, the Bar Council of India's notification to law colleges/universities that term-end examinations would be conducted prospectively rather than retroactively has been a relief. It has been made clear, therefore, by the BCI, that its circular of June 9 will have no effect on semester results already published for the LLB course. BCI's decision has also led Mumbai University to withdraw its July 5, 2021 circular, which canceled various semester results for the LL. B degree and replaced them with assignments. It was announced on Monday that the high court had taken a harsh stance against BCI over its decision to withdraw Mumbai University's 3-year LLB and 5-year LLB semester II and IV results as a result of BCI's actions.

"We are grateful for the Respondents' current stance. Many law students who have been traumatized by respondents' actions will now be relieved of that trauma," he said. " Justices RD Dhanuka and RI Chagla dismissed the petition. She also claimed that once the results were announced, they could not be canceled and replaced with assignment-based evaluation. Furthermore, students were asked to complete 10 assignments in just 21 days, with no access to online instruction. Counsel for Mumbai University Ashutosh Kulkarni claimed that Ferns was the only student who had been harmed by the deadline for submitting assignments. According to UGC Guidelines issued in April 2020, however, the University of Mumbai could not "prima facie" withdraw results that had already been declared based on previous semester scores. Bar Council of India counsel Amit Sale said on Wednesday that the Bar Council of India does not intend to retroactively apply the decision recorded in the Bar Council of India's Circular dated 9th June 2021, mandating that all law colleges and universities conduct end-term examinations. Law Colleges/Universities will not be impacted by this decision if they declare results based on previous semester scores prior to the 10th of June 2021, in accordance with UGC guidelines issued in April of 2020.

In its order, the High Court recorded the following statement from the BCI: In a circular dated June 9, 2021, and a press release dated June 10, 2021, the Bar Council of India states that it does not intend to apply the decision mandating end-term examinations at all law colleges and universities with retrospective effect, but only with prospective effect.
