The Allahabad High Court, hearing a petition brought by an ex-Indian Army veteran alleging that he was humiliated and severely abused by the Uttar Pradesh Police, stated last week that the State Government was continuing to exhibit nothing against the local policeman's ostensibly reprehensible behavior. Justice Surya Prakash Kesarwani and Justice Gautam Chowdhary of the Surya Prakash Kesarwani and Justice Gautam Chowdhary Bench specifically stated: "...we are compelled to note that the State Government continues to show prima facie inaction in the face of an ostensibly shameful act by a local police officer current situation can no longer be accepted." Moreover, because the Government Advocate requested an adjournment on July 22 because he was unable to make the argument through video conferencing due to personal reasons, the Court adjourned the case and set a new hearing date for July 27.

Before adjourning the case, the Court examined the case records and read the supplemental affidavit filed by the State. During the previous hearing, the Uttar Pradesh government told the Allahabad High Court that it had taken action against the accused police officers and that an SIT had been formed to look into the case.

The State Government's response came in the wake of severe statements made by the Bench of Justice Surya Prakash Kesarwani and Justice Gautam Chowdhary about the Uttar Pradesh police's operation. In essence, the Court had taken into account the victim's injury reports and FIR filed by the ex-army man on July 8 and had said: "...at first glimpse, (it) uncovers a sorry state of affairs and police brutality... It appears to indicate that the accused police officers/police officers have violated the petitioner's fundamental freedoms as secured by Article 21 of the Indian Constitution." The Bench had directed the State DGP to file a counter-affidavit using his personal affidavit, indicating the action taken in the matter, stressing that the issue is severe and requires significant consideration by the Court. On social media, a video of the incident was also shared. The officers accused of assaulting him have been suspended, it should be noted.
