DELHI HC: Grants bail to “BULLI BAI” app creator. On 4th of July 2021 many Muslims women’s pictures were posted as “deal of the day on the Twitter” on the consequence of which several accounts started speaking against the SULLI DEALS Apps which was hosted on GITHUB as “open source-project”. Basically the case is related to the online mock auction of the Muslims journalists and activists and their pictures were uploaded without their permission; the app doesn’t only sell anyone but harasses and humiliates these Muslim women.

After multiple of complaints GITHUB took the app down and suspended the “SULLI DEALS” account. The investigation was conducted by the Delhi police on the SULLI DEALS case and until the end of 2021 they didn’t make any arrests but, In January 2022 Delhi police asserted to have arrested the creator of the SULLI DEALS APP from Indore Madhya Pradesh. The police launched the investigation in at least three states namely-MUMBAI, DELHI, UTTARAKHAND. The police have linked the creators of the app to alt-right groups inspired by Neo-Nazism. The creator of the app had used the Sikh religion names to mislead peoples. On 9th March 2022, the Delhi police filled a charge sheet, charging accused persons with offenses including section 153A (Promoting enmity between religious groups), section 153B (causing disharmony), 354A (3) (sexual harassment) and section 509 (Insulting the modesty of a woman) of IPC.

The first arrest in the case was VISHAL KUMAR JHA (21), a second year civil engineering student, from Bangalore made on 4th January, and Next accused was SHWETA SINGH (18), a junior college student from UTTARAKHAND with MAYANK RAWAT (21), a second year BTEC student, also caught from UTTARAKHAND on 5th January, NEEERAJ SINGH (28) a postgraduate from business administration from ODISHA, was the sixth accused arrested on 21st January. At the beginning of the month Mumbai’s cyber police filed a charge sheet before the Bandra court.

RASHMI KARANDIKAR, DCP (cyber-Mumbai), confirmed the over 1400 –pages charge sheet had been filled with technical evidences. The cyber police stated that the complaint was filed by the 34-year-old social worker from ANDHERI (E). A second-year BTECH student, BISHNOI of 20 years old was arrested from his home state Assam by Delhi police special cell’s intelligence fusion and strategic operation unit on 6th January and on 9th January THAKUR was arrested. During the investigation, BISHNOI had disclosed that the app was developed in November 2021 and updated in December and also allegedly created a Twitter account to talk about the app.

Considering the accused to be not Habitual offenders, a Delhi high court on Monday granted bail to NIRAJ BISHNOI, accused in “BULLI BAI” app case, and co-accused OMKARESHWAR THAKUR, who is creator of ‘SULLI DEALS’ apps on Humanitarian grounds. The court said that the “accused is a first time offender as such prolonged incarceration would be detrimental to his overall well-being. Accused has roots in the community, and he is not a flight risk. The trial would take considerable time to save as such no fruitful purpose would be served by keeping them detained any further”. The court however granted bail upon the conditions by imposing strict restrictions on the accused to ensure that they do not tamper with evidence or threaten witnesses. The accused were also ordered to not contact or influence any witnesses in the case and to keep their mobile phones switched on at all the times and provide their current location if asked by the investigation officer (IO) and not to leave the country and would have to appear whenever required by the court.
