The civic body North Delhi Municipal Corporation (NDMC) has informed the Hon’ble Supreme Court that the Jahangirpuri demolition drive was given an unwarranted communal colour by the petitioner. During the anti-encroachment drive in Jahangirpuri, No houses were demolished at all and the exercise did not target any of the community, the civic body of the North Delhi (NDMC) told the Supreme Court. Muslim body Jamiat Ulama-i-Hind and the CPM are the petitioners in the matter. And in response to the petitions challenging the exerciser in Jahangirpuri, the North Delhi Municipal Corporation termed the allegations ‘blatant falsehood’ and sought actions against the petitioners. All this information was presented before the apex court, as per the filed affidavit by the North DMC, Commissioner.
And it is also declared by the presented affidavit that the whole exercise was done in the perspective of the orders provided by the High Court of Delhi i.e, the exercise must be undertaken to ensure the citizen's freedom of the movement. And it was openly informed by the authority that the demolition drive will continue unless a court’s stay order is shown because the affected party misleads the authority by wrongful contention that there is a stay related to the running drive. The respective authority cleared “Under section 322 of the Act, the affected parties mislead the authorities by wrongly contending that there is a stay by the court” North DMC submitted it. Countering the petitioners, NDMC has stressed the facts in the affidavit that, the allegations of the particular religion or community being targeted by NDMC, are a motivated and fake assertion of the petitioner, who deliberately and willfully tried to sensationalise the matter.
Only projections on the public road, unauthorized temporary structures and shops were removed during the demolition drive in addition with it, was also explained by NMDC that the building line remained intact and sacks of garbage and structures well beyond the boundary of the houses and shops are removed. And it was also stated that there is no requirement for any notice under the provision of the Delhi Municipal Corporation Act. Chief Justice of India leading a bench passed a status-quo order on the demolition on April 20. And NDMC also informed that though the drive ended at noon, for some time, the debris on the road was being removed.
