The death of Covid-19 patients due to a shortage of oxygen supply to hospitals, according to the Allahabad High Court, is a criminal act, that is "not less than genocide" by the authorities entrusted with ensuring the oxygen supply chain is preserved. The comments were made in response to news stories circulating on social media about the death of Covid-19 patients in Lucknow and Meerut districts due to a shortage of oxygen.
A court-ordered investigation into the events was also released. The order was issued on a Public Interest Litigation concerning the spread of Covid-19 in the state and the condition of quarantine centers by a two-judge bench consisting of justices Siddharth Verma and Ajit Kumar. "We are pained to note that the death of Covid patients simply because oxygen was not supplied to hospitals is a criminal act and not less than genocide by those charged with ensuring the continuous procurement and supply chain of liquid medical oxygen."
The Allahabad High Court said, “How can we allow our people to suffer in this way when medicine has progressed to the point where heart transplantation and brain surgery are now routine?” It went on indefinitely. Normally, we would not have instructed the state and district administrations to investigate such news that has gone viral on social media, but because the advocates who appeared in this PIL endorsed such news and also submitted that more or less similar situations exist in other districts of the state, we believe it is appropriate to guide the government to take immediate remedial action. The court ordered the DMs of Lucknow and Meerut to investigate certain news items within 48 hours and send reports on the following date. They are also required to appear in court electronically on the next scheduled hearing date. Last Sunday, the court was told of a viral news item stating that five patients died in the ICU of a new trauma centre at Medical College, Meerut.
Similarly, Sun Hospital in Gomti Nagar, Lucknow, and another private hospital in Meerut had withheld admission of Covid-19 patients due to a lack of oxygen supply even after demand.
