The High Court on Friday denied a plea by a man trying illegally to evict his elderly mother and thus applied for the petitioner to charge him Rs 1 lakh. After concluding that plea as an unfortunate petition, Justice Arvind Singh Sangwan observed with anxiety, 'A review of the representation also reveals that the representation had been filed for oblique reasons to harass his own mother so that the petitioner would be apparent both from the police representation and the contents of the petition, based on its general authority. In the instant, the petitioner's father was entitled to a decision by November 11, 2013, in which the petitioner received 50% of the home share and the other 50% was handed to his wife, i.e. the petitioner's elderly mother. This was done to ensure the petitioner's elderly mother had a residence in which to live for the rest of her life.

The petitioner then reported to the Court that he had acquired the Attorney General's authority over the portion of the property for his mother. In rejecting this claim, the Court said that it was clear from the evidence that the petitioner was dishonest, for he was meant "to put away a senior citizen's mother from the property and to sell it." The Court, therefore, resolved the petition by charging the petitioner with expenses. Of order that the expenses in Rs 1 lakh be collected from the petitioner, the Chief Judicial Magistrate SAS Nagar (Mohali), was requested and subsequently paid to the petitioner's old mother within two months.
