The Bombay High Court has granted Alia Bhatt and the Gangubai Kathiawadi producers an interim stay on criminal defamation charges. The summons was issued by the Metropolitan Magistrate in Mazgaon, Mumbai, in response to a defamation case brought by one Babuji Shah, who claims to be Gangubai Kathiawadi's adoptive son. The Bombay High Court recently delayed the summons issued by a Magistrate Court in a criminal defamation charge brought against makers of the film Gangubai Kathiawadi and actress Alia Bhatt. In a defamation case brought by Babuji Shah, who claims to be Gangubai Kathiawadi's adoptive son, the Metropolitan Magistrate in Mazgaon, Mumbai, issued a summon. The producers, Bhansali Production Private Limited, Sanjay Leela Bhansali, and Alia Bhatt, challenged the summons in the High Court.
Senior Advocate Abad Ponda, who represented the producers and Bhatt, stated that they were unaware of the existence of Shah, Gangubai Kathiawadi's claimed adopted son. Justice Revati Mohite Dere delayed the proceedings after serving notice on the respondents. The next hearing date is September 7, 2021. Shah has also appealed to the Supreme Court against the Mumbai City Civil Court's dismissing judgment. S Hussain Zaidi and Jane Borges were sued in the lower court for a permanent injunction prohibiting them from publishing, selling, or creating third-party rights to their work. Shah requested an urgent stop on the film's release from the producers in an interim plea filed in the appeal. Shah had also failed to establish that the claimed slander had caused him any legal harm, he noted. In a defamation case, Justice Nitin Sambre pointed out that the Torts concept that "an action dies with the person" must be taken into account.
"The contents of the defamatory nature against the Appellant's so-called adopted mother dies with her death," Justice Sambre said. The Court also dismissed the interim application because Shah had failed to show that he is Kathiawadi's adopted son. Ponda and Khandeparkar, who were briefed by a team from DSK Legal consisting of Partner Chandrima Mitra, Associate Partner Parag Khandhar, and Principal Associate Prachi Garg, represented Bhansali Productions and Bhatt. Advocates Madhu Gadodia and Sujoy Mukherji of Naik Naik & Company represented Zaidi and Borges.
