The Apex Court heard a petition challenging a recent order of the Calcutta High Court which dealt with the sale, purchase, use, display of firecrackers during festivals like Diwali, Kali Puja, Chaath Puja, Guru Nanak's Birthday, Christmas, and New Year's Eve. The Supreme Court said that the top court's order applies uniformly to all States. The Supreme Court order of July 2021 and October 2021 had banned the use of barium salts in firecrackers while allowing the use of green crackers. The petition was heard by a special vacation bench of Justice A.M. Khanwilkar and Justice Ajay Rastogi.
Sara Bangla Atasbazi Unnayan Samiti is a firecracker association and the petitioner Goutom Roy is the chairman of the mentioned association. It was noted that around seven lakh families are directly or indirectly dependent on this industry. Their interest should be taken into mind while considering the ongoing problems in the economy. Financially surviving a pandemic without employment is an impossible task.
There is a complete ban on the usage as well as the sale of firecrackers including the green crackers throughout the State of West Bengal imposed by the Division Bench comprising of Justice Sabyasachi Bhattacharya and Justice Aniruddha Roy of the Calcutta High Court. This decision was taken as the Festive Season was just around the corner. Roshan Ali, the petitioner said that the celebration through bursting crackers will put a toll on the health of Indian citizens along with the pandemic. It was noted that the use of wax or oil-based diya shall be permitted. It was later submitted that the larger interests of citizens must be kept at bay as against the smaller interest of firecracker manufacturers, their families, and others concerned with such business.
