After the arrest of the TMC leaders concerning the Narada case, a special bail was granted by the CBI court but was stayed by the high court on the same day by the division bench.

A five-judge bench, along with the Chief Justice, has awarded an interim bail and adjourned other issues pertaining to the matter. The CBI citing a threat to the probe agency on the ground that West Bengal CM and TMC ministers were sitting on dharan outside the agency’s office, had sought to transfer the case. The division bench had passed an order on May 21 directing the four TMC leaders to be placed under house arrest, and the CBI had filed an appeal on the same for which the top court refused; therefore, on appeal against the stay order, a five-judge bench was constituted.

However, the bench now has considered the arguments raised by the senior counsels for grant of interim bail for the accused when the matter is still pending before the court. The Solicitor General had objected, stating that the accused were influential persons who can create legal or factual issues on the matter for which the court has said: “may require some time for final determination.” The bench has proposed to grant bail to 4 accused, namely Shri Firhad Hakim @ Bobby, Shri Madan Mitra, Shri Sovan Chatterjee, and Shri Subrata Mukherjee, subject to conditions as mentioned by the court. The subjections were the execution of a bond of Rs. 2 lakhs with two sureties; the persons above are available in the course of further investigation as, and when required by the CBI considering the lockdown imposed in West Bengal, the interrogation may be through virtual mode. They shall not give any press interview or make any public comments in relation to the unsettled case before the court.

The accused with interim bail were asked to file an undertaking before 31st may before the registrar general of the same court and the court of CBI comply with the said conditions. The interim bail would be canceled in the case of violation of the said conditions, and the interim would continue until further order, said the court, “Filing of the undertaking shall not be pre-condition to release of the accused person on executing the bail and furnishing sureties in terms of the order.” The primary matter to be heard on 31st may. On behalf of CBI, Tushar Mehta, Solicitor General of India, and Additional Solicitor General Y. J. Dastoor, along with Advocates Kanu Agarwal and Samrat Goswami, had appeared. On behalf of Firhad Hakim, Senior Advocates Dr. Abhishek Manu Singhvi and Siddharth Luthra, along with Advocates Debanjan Mandal of M/s. Fox & Mandal, Kolkata, Kunal Vajani, Suhaan Mukherji, Sabyasachi Banerjee, Sandip Dasgupta, and Gopal Chandra Halder had appeared. Sovan Chatterjee, Summer Sodhi, Sourav Chatterjee, Partha Pratim Dasgupta, and Debayan Sen appeared. On behalf of Subrata Mukherjee Senior Advocates Dr. Abhishek Manu Singhvi and Kalyan Bandhopadhay and Advocates Sabyasachi Banerjee, Kunal Mimani, Ayan Kr. De had appeared. On behalf of Subrata Mukherjee, Senior advocate Siddharth Luthra, along with Advocates Niladri Bhattacharya and Soham Bandopadhay, had appeared. Kishore Datta, Advocate General, along with Abhratosh Majumdar, Additional Advocate General, and Advocate Sayan Sinha, appeared on behalf of West Bengal. Senior Advocate Rakesh Dwivedi appeared on of Chief Minister Mamta Banerjee and Law Minister Moloy Ghatak.
