In Rajasthan, a district judge was suspended after he was alleged of sexual assault of a 14-year-old boy. Jitendra Singh is a district judge posted as a special judge in the special court, Prevention of Corruption Act in Bharatpur, Rajasthan. On Sunday, 31 October 2021, he was suspended from his post after a case was filed against him and 2 other people alleging them of sexual assault of a 14-year-old boy. This case was registered under the relevant sections of the Prevention of Children from Sexual Offences Act, 2012.
Prevention of Children from Sexual Offenses Act, 2012 also known as the POCSO Act was enacted to protect children from offences of sexual assault, sexual harassment, and pornography and also provides for special courts for trial of such offences and matters connected to such offences. The act defines children as someone under the age of 18 as a child. The FIR was also registered under section 377 of the Indian Penal code 1860, which illustrates unnatural offences as criminal activity. As per the section, whoever has sexual activity against the course of nature will be punished.
Jitendra Singh allegedly befriended the minor while he visited the District club to play tennis. He has been accused to take the boy to his house where he performed unnatural sex with him. He also threatened to frame his family in false cases if he told anyone about the same. The matter came into light last week when the boy told his mother about the alleged assault which led to the filing of an FIR in the Mathura Gate Police Station. Jitendra Singh, the district judge cadre was suspended immediately following the FIR and along with him, two other people who were accused of threatening and molesting the minor were also suspended. They were accused of intoxicating the boy with narcotic substances and molesting him after he lost consciousness.
An Anti-Corruption Bureau (ACB) Officer was one of the two members accused of the same. He has been accused of threatening to kill the boy. The ACB officer has also been suspended as per the Rajasthan Civil Services (Classification, Control, and Appeal) Rules, 1958. Following the FIR, a video has gone viral in Bharatpur showing Jitendra Singh, the judge apologizing to the mother of the minor boy. However, the court has yet to determine the genuineness of the video which is still awaiting forensic examination. On the other hand, Jitendra Singh has also filed a counter-report on the mother of the boy and his family, accusing them of extortion as well as blackmail.
The matter is in the hands of the Rajasthan State Commission for Protection of Child Rights. The chairperson of the commission has asked the relevant authorities to investigate the matter and the physical examination of the boy has been conducted. Hence, the chairperson of the Commission has asked for the factual report on the matter and assured the parties involved that the authorities will be looking into the matters as carefully and diligently as possible.
