The Bar Council of India in its notice with regard to the examination of the LLB students has said that it is mandatory to conduct exams for end semester students and universities are free to decide the mode of examination whether Online/Offline/Blended/Online Open Book Exam (OBE)/ Assignment Based Evaluation (ABE)/Research papers.
The BCI had appointed a high-level committee to resolve the issue of the LLB examination. The issued notice was the result of a detailed report submitted by the High-Level Committee. The issue began when the BCI was flooded with letters and requests from students and many universities and law colleges of the country and sought guidance in this matter. The majority concern along with the final year students was to promote on the basis of past performance or through some other method of assessment. BCI in response to this issue said that it did not wish to enter into the examination matters and accordingly universities can make their independent decisions in pursuing the local scenario.
In this regard, the BCI had also tracked the decisions of the apex court and the high court of Karnataka in that matter. The intention was to maintain a standard of legal education and the problems of students and institutions was/is also to be taken care of. The counsel is the regulator and considering the fact that every student cannot afford the court of law. Further to tackle this problem the High-Level Committee was formed to submit a detailed report on the same. The committee was headed by Hon’ble Mr. Justice Govind Mathur, former Chief Justice of Allahabad High Court; members of BCI, Director of Indian Law Institute, Vice-Chancellors of National Law University Delhi, Bhopal, Nagpur, National Law School of India University Bengaluru, O. P. Jindal Global University Sonipat and professors and law faculty from reputed universities.
The report came out to be that, each University/Centers of Legal Education shall conduct examination for intermediate and final year students, as per their own dispensation, depending upon the availability of resources and the impact of COVID 19 in that region, and end-term examination is mandatory to be conducted by all Law Schools/Universities. The Committee gave recommendations that Universities should ensure a sufficient time gap between regular and backlog examinations to avoid inconvenience to the students. The committee in the note of the previous decisions of the BCI which stipulated examinations for all semesters, and guidelines issued regarding the mode of conduct of examination/evaluation, has agreed that universities are free to determine the mode of evaluation/examination for promotion and for the award of the Law Degree and for the conduct of the examination. Hence the report is accepted by the BCI and resulted in a press release on 10th June 2021.
